Judge Orders Eviction of the Montserrat Caballé Foundation For Non-Payment of Rent

A court in Barcelona has ordered the eviction of the Montserrat Caballé Foundation from an apartment where the late singer’s brother, Carlos Caballé, lives.

The company that owns the property has filed a complaint against it for non-payment of rent since 2023, amounting to 41,000 euros, according to the court. Caballé and the Foundation are facing an eviction order which would become effective on October 3 at 10 am, if still unpaid.

El País reported that Carlos Caballé’s lawyer has attempted to temporarily suspend the eviction in a document filed on July 14, citing that Mr. Caballé is in his eighties and without alternative housing. The document was accompanied by a report from Barcelona City Council’s social services.

On July 22, the Montserrat Caballé Private Foundation issued a statement regarding the reports of its impending eviction. The statement outlines that there is no affect to the Foundation’s activities or objectives, and that it wishes to “resolve the situation diligently and discreetly, as soon as possible.” The letter ends with, “At no time has there been, nor is there, any kind of family fracture, and therefore we categorically deny this. The Foundation maintains its firm commitment to culture and the musical and vocal training of young talents, preserving the work and memory of Montserrat Caballé with responsibility, discretion, and institutional rigor.”

This is not the first time the Caballé family has faced legal problems. In 2014, Montserrat Caballé had legal problems with the Tax Agency for tax evasion. She admitted to having defrauded just over half a million euros, corresponding to 2010 income, by falsely declaring that she resided in Andorra, when in fact she lived in Barcelona. At that time, the Prosecutor’s Office filed a complaint for tax crimes, and the artist accepted a plea deal to avoid trial. The result was a six-month prison sentence, which she did not serve due to her lack of prior criminal record, along with a €250,000 fine, in addition to repaying the defrauded money with interest. In total, the soprano then paid €835,000

The Montserrat Caballé Foundation was launched in 2019, and registered in the Registry of Foundations the following year. The foundation’s board of trustees is chaired by the soprano’s niece, Montserrat Caballé Claus.
